EULA - End User License Agreement

END-USER LICENSE AGREEMENT

PLEASE READ AND ACCEPT THE FOLLOWING END-USER LICENSE AGREEMENT FOR ORDIX AVI JOINER BEFORE PROCEEDING. IT CONTAINS IMPORTANT INFORMATION THAT YOU SHOULD KNOW BEFORE CONTINUING TO USE OUR SERVICE OR SOFTWARE.

LICENSE
This End-User License Agreement (The "AGREEMENT") is a legal agreement between you ("LICENSEE"), the end-user, and Ordix Interactive ("ORDIX") for the use of the ORDIX AVI JOINER software product ("SOFTWARE"). By using this SOFTWARE or storing this program on a computer hard drive (or other media), you are agreeing to be bound by the terms of this AGREEMENT. If you do not agree to the terms of this AGREEMENT, promptly delete the SOFTWARE from all storage media.

USE OF THE SOFTWARE
You may install this program to test and evaluate if it suits your needs and you wish to purchase it; during the evaluation period, you will be shown nagscreens to encourage users to register the SOFTWARE. There is no evaluation time limitation. While you are evaluating the SOFTWARE, you may use it on as many computers as are required to perform your evaluation. You must not (a) defeat, or try to defeat, messages in the SOFTWARE which encourage users to register, or actively discourage user registration in any other way; (b) modify, rent or resell for profit this SOFTWARE, or prepare AND/OR create derivative works based upon this SOFTWARE; (c) decompile, reverse engineer, disassemble or otherwise reduce this SOFTWARE to a human perceivable form; (d) publicize or distribute any registration code algorithms, information, or registration codes used by this SOFTWARE without permission of Ordix Interactive; (e) use any registration codes for the SOFTWARE that have not been purchased from ORDIX or an authorized representative of ORDIX.

DISTRIBUTING COPIES OF THE SOFTWARE
You may distribute freely the unregistered version of the SOFTWARE on online services, bulletin boards, or any other electronic media as long as the files are distributed in their entirety without a fee. You may not: (a) distribute registered versions of the SOFTWARE; (b) distribute unregistered versions of the SOFTWARE on CD-ROM, disk, or other physical media for a fee without the permission of Ordix Interactive.

FREE UNLIMITED LIFETIME UPGRADE POLICY
After purchasing the SOFTWARE, you are entitled to free unlimited lifetime upgrade of the SOFTWARE. With effect from 1st December 2003, ORDIX reserves the rights to withdraw this free policy at any time prior to a notification to the LICENSEE. In no event shall ORDIX be liable for consequences following this withdrawal even if the LICENSEE has not acknowledge the notification.

NO REFUND POLICY
ORDIX provides full functionality SOFTWARE without evaluation time limitation. You are expected to test and evaluate the SOFTWARE before purchasing. Therefore, no refund will be granted unless under special circumstances. Refunds dispute will be handles on case by case basis and ORDIX reserves the rights to evaluation such situations.

COPYING REGISTERED VERSION OF THE SOFTWARE
When you receive the registration codes of the SOFTWARE you may/should make copies of the codes which are necessary for normal backup purposes only. You agree not to sell or give any copies of the registration codes to others.

LEGAL DISCLAIMER
ORDIX EXPRESSLY DISCLAIMS ANY WARRANTY for the SOFTWARE. The SOFTWARE and any related documentation is provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or non-infringement. The entire risk arising out of use or performance of the SOFTWARE remains with you. THIS SOFTWARE IS NOT FAULT TOLERANT AND SHOULD NOT BE USED IN ANY ENVIRONMENT WHICH REQUIRES THIS. NO LIABILITY FOR DAMAGES. In no event shall ORDIX or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this SOFTWARE, EVEN IF ORDIX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
